Agreement and acceptance

These Terms of Service and Studio Purchase Agreement (the “Agreement”) govern your purchase and use of memberships, class packages, drop-in classes, workshops, series, private sessions, virtual offerings, events and other services (collectively, the “Services”) offered by Abode Yoga LLC, doing business as Abode Yoga (“Abode,” “we,” “us,” or “our”). They also govern your use of www.abodeyoga.com, any related mobile experience, and Abode’s booking platform (collectively, the “Website”).

By purchasing a Service, or participating in a Service, you acknowledge that you have read and agree to this Agreement and the policies expressly incorporated into it.

If there is a conflict between this Agreement and a written offer describing a particular workshop, retreat, private session or other special program, the written terms of that specific offer control only for that program.

1. Eligibility, accounts and communications

You must provide accurate, current contact and payment information and protect your account credentials. You are responsible for purchases and reservations made through your account unless you promptly notify Abode of unauthorized access.

You consent to receive transactional communications relating to purchases, reservations, schedule changes, safety, billing and account administration. Marketing emails and text messages will be sent only as permitted by applicable law, and marketing consent is not a condition of purchase.

2. Services and schedule

Class descriptions, teachers, schedules, formats and locations may change. Abode may substitute an instructor, modify a class, move a class online, limit capacity, or cancel a class when reasonably necessary. If Abode cancels a single class, the applicable reservation will be returned to the customer’s account or otherwise handled under the posted Studio Policies. A schedule or instructor change alone does not automatically entitle a customer to terminate a membership except where applicable law provides otherwise.

3. Prices, payment and purchase terms: The price, taxes, commitment period, included Services, billing frequency and total payment obligation applicable to a purchase will be disclosed at checkout or in the signed order before the purchase is completed. You authorize Abode and its payment processor to charge the payment method you provide for amounts you approve, including applicable recurring charges.

Prices may change prospectively. A price change will not alter an already-purchased fixed package or prepaid program unless the applicable offer expressly permits it. Changes to recurring membership charges or benefits will be communicated within the time and manner required by law.

Failed payments: If a payment fails, Abode may retry the charge, request an updated payment method, suspend booking privileges, or pause access until the balance is resolved.

4. Memberships and automatic renewal

Before a recurring membership is purchased, Abode will clearly disclose:

that the membership continues until the customer cancels, if it is continuous;
the amount and frequency of recurring charges and whether the amount may change;
the length of each renewal term;
any minimum commitment;
the deadline and method for cancellation; and
any membership freeze, notice or early-termination terms.

Abode will obtain the customer’s affirmative consent before charging for automatic renewal and will provide a retainable acknowledgment containing the renewal terms, cancellation policy and cancellation instructions. A customer who enrolls online will be permitted to cancel the automatic renewal at any time by emailing alyssa@abodeyoga.com. Cancellations are made effective immediately, and no further charges will be made.

Membership-specific business terms:

Single drop-in: $32. Expires 14 days from date of purchase.

Intro offer: 3 classes for $30. Expires 14 days from date of purchase. Includes free mat usage.

4 class pack (non auto-renew): $112. Expires 2 months from date of purchase.

4 class pack (auto-renew): $92. Auto-renews every month. Includes free mat usage. Commitment of 3 months. Billing date begins on date of purchase. Require 30 day notice for freeze or cancelation. Freezing of one’s account can be done for up to 3 months.

8 class pack (non auto renew): $208. Expires 4 months from date of purchase.

8 class pack (auto-renew): $160. Auto-renews every month. Includes free mat usage. Commitment of 3 months. Billing date begins on date of purchase. Require 30 day notice for freeze or cancelation. Freezing of one’s account can be done for up to 3 months.

Monthly unlimited (auto-renew): $170. Auto-renews every month. Includes free mat usage. 10% Discounts on workshops and retail. No commitment period. Billing date begins on date of purchase. Requires 30-day notice for freeze or cancelation. Freezing one’s account can be done for up to 3 months.

Founding member rate (auto- renew): $145. Lowest membership price. Limited to 25 members. Auto-renews every month. 10% Discount on workshops and retail. No commitment. Billing date begins on the date of purchase. Requires 30-day notice for freeze or cancelation. Freezing one’s account can be done for up to 3 months. Should an individual cancel from this membership, they forfeit the introductory price and will have to obtain the current membership prices for 4-pack auto-renew, 8-pack auto-renew, or Monthly Unlimited.

4. Studio cancellation, freeze and refund policies

Membership cancellation: Cancellation requests must be made 30 days prior to the billing date.

Membership freeze: Auto- renew packages are eligible for a freeze. Members can freeze their accounts for up to 3 months and must be done in 30-day increments. To obtain a freeze, a member must email alyssa@abodeyoga.com with the effective freeze start and end dates.

Late cancellation/no-show: Cancellations can be made up to any point before the start of class time. If an individual cancels within 6 hours of class, we consider this a late cancel, and they will incur a $15 charge and lose the credit that was used to book class. If any client no-shows class, they will incur a $20 no-show fee and forfeit the class credit used.

Class-package expiration: Non-auto-renew packages have expiration dates. The Single Drop In and 3 classes for $30 both expire within 14 days from the date of purchase. The 4-class pack expires within 2 months from the date of purchase, and the 8 Class Pack expires within 4 months from the date of purchase.

Transfers: No memberships or class credits are transferable.

Workshops and series: If participation is less than 3/4 full at minimum 2 weeks prior to the workshop or training, the host of the workshop or training has the right to cancel said workshop or training with a full refund to go to participants.

Private sessions: For private 1:1 sessions, if a client cancels within 12 hours of the session, they will get their credit back; if a client cancels within less than 12 hours of the session, they will lose their credit.

Weather/emergency closure: In the event of severe weather or emergency closure, anyone who is signed up for class will receive their class credit back if on a class package membership, both auto-renew and non-auto-renew, Single Drop-in, 3 for 30. If a client holds an unlimited membership, they will be credited with a guest pass to compensate for the missed class. There will be no late cancel or no- show fees applied.

5. Yoga participation, health and personal responsibility

Yoga, fitness, breathwork and related activities involve physical exertion and carry inherent risks, including strains, sprains, falls, aggravation of an existing condition and other injury. Participation is voluntary. You are responsible for deciding whether a Service is appropriate for you, working within your capacity, stopping when needed, and seeking advice from a qualified healthcare professional when appropriate.

You agree to inform the instructor, privately when appropriate, of relevant injuries, pregnancy, health conditions or physical limitations that may affect participation. An instructor’s modification, cue, adjustment or suggestion is educational and is not medical diagnosis, treatment or individualized medical advice. You may decline any movement, pose, prop, breath practice or hands-on assist.

Before participating, each participant must separately accept Abode’s current Participant Waiver and Release. This Agreement does not replace that waiver.

6. Hands-on assists

Abode may offer verbal instruction, demonstration, and optional hands-on assists. You may decline touch at any time, including after previously consenting. Individuals can consent or decline hands-on assists verbally with the instructor leading class. Declining hands-on assistance will not affect access to instruction.

7. Studio conduct and right to refuse service

Abode is committed to a respectful, inclusive, and safe environment. Participants must follow reasonable staff instructions and must not harass, threaten, discriminate against, intimidate, photograph without consent, engage in unsafe behavior, disrupt a Service, or attend while impaired in a manner that creates a safety risk.

Abode may deny entry, require a participant to leave, suspend booking access, or terminate a membership for material or repeated violations of this Agreement or conduct that reasonably threatens safety or operations. Abode will determine whether a refund or credit is appropriate, subject to applicable law.

8. Personal property and facilities

You are responsible for personal property brought to the studio. To the fullest extent permitted by law, Abode is not responsible for lost, stolen, or damaged property unless caused by Abode’s legally actionable conduct. Participants must use studio facilities and props as directed and promptly report hazards, damage, or injuries.

9. Virtual and recorded Services

For virtual participation, you are responsible for selecting a safe practice area, maintaining suitable equipment and internet access, and ensuring that children, pets, and household conditions do not create hazards. Access links and recordings are for the registered customer’s personal, noncommercial use and may not be shared, copied, recorded, sold, publicly displayed or redistributed unless Abode gives written permission.

10. Photography, recording and testimonials

Abode will not treat participation alone as consent to use a participant’s identifiable image, voice or testimonial for marketing. Any marketing use will be governed by a separate consent or release. Abode may prohibit customer photography or recording to protect privacy and intellectual property. Operational or security recording, if any, will be disclosed and addressed in the Privacy Policy.

11. Third-party services and privacy

Abode may use third-party providers for scheduling, payment processing, email, video delivery and other business operations. Those providers may have their own terms and privacy practices. Abode’s handling of personal information is described in its Privacy Policy at www.abodeyoga.com/privacy-policy, which is incorporated by reference to the extent permitted by law. Abode does not store complete payment-card information when payment is handled directly by its payment processor.

12. Limitation of liability

To the fullest extent permitted by law, Abode will not be liable for indirect, incidental, special, exemplary or consequential damages arising from the Website or Services. Any limitation must be construed consistently with the separate Participant Waiver and Release and does not apply to liability that cannot legally be limited.

13. Governing law and disputes

This Agreement is governed by Illinois law, without regard to conflict-of-law rules. Any court proceeding permitted under this Agreement will be brought in a state or federal court with jurisdiction in Cook County, Illinois

14. Changes to this Agreement

Abode may revise Website-use terms prospectively by posting an updated version and effective date. A material change to an active paid membership will be communicated in advance and will not retroactively eliminate accrued rights. Where applicable law requires renewed consent, notice alone will not replace that consent.

15. General terms

This Agreement, the applicable order or checkout disclosure, the Studio Policies, the Privacy Policy and the separate Participant Waiver and Release constitute the agreement governing the applicable relationship. If a provision is unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect. Abode’s failure to enforce a term once is not a waiver of future enforcement. You may not assign this Agreement without Abode’s written consent; Abode may assign it in connection with a lawful sale or reorganization, subject to applicable consumer rights.
